The Florida legislature has decided that when a couple get divorced they’re going to treated the same way as if a two person business partnership dissolved. When a two person partnership dissolves then all their assets and all their debts start off being divided equally. That is the presumption by Florida statute when a couple divorces. They’re going to try to divide their assets and their liabilities equally. Now, there can be an unequal distribution, the couples can agree to an unequal distribution, the courts under limited circumstances can provide for that an unequal distribution, but generally speaking we’re looking at an equal division of debt.
